We will review any claim with you free of charge either at our toll free number 1-888 NPS-LAWS (1-888-677-5297) or by email. Your questions will be answered by a lawyer, not a paralegal. We visit homes and hospitals free of charge anywhere in New York or Pennsylvania to assist our clients.
HOW DO LEGAL FEES WORK?
The legal fee is one third or 33.33% of the settlement. If you receive no settlement, there is no obligation for legal fees.
WILL WE BE RESPONSIBLE FOR UP FRONT COSTS?
NPS will not ask you for upfront money to cover the costs of processing your claim such as costs involved in obtaining medical records, investigators, process servers and court filing fees. However the client will be responsible for reimbursement of these costs from the final settlement.
WHEN SHOULD A CLAIM BE MADE?
The sooner you start processing the claim, the sooner it will be settled in most cases. You want to get the jump on the insurance company by obtaining photographs and witness statements as soon as possible (before the insurance company does).
SHOULD I TALK DIRECTLY WITH THE INSURANCE COMPANY?
We do not recommend this. Insurance companies often tape record conversations. They know what they want to hear and can very artfully "put words in your mouth" that you don't really mean. Be weary of friendly insurance people.
HOW LONG DO I HAVE TO MAKE A CLAIM ?
This varies from state to state. In New York an adult has
three years, a child has until he is 21. In Pennsylvania, an adult
has two years, a child until he is 20. Be careful, a claim against
a governmental body may need to made in a much shorter time, usually
90 days.
WILL MY CASE GO TO COURT?
We settle most cases out of court. We'll only go to court if its absolutely necessary. We make every effort to persuade the Insurance Industry to do what's right and pay a fair settlement. But if the Insurance Company won't pay or pay enough, we'll be prepared . The Insurance Industry knows this about NPS. We believe that is why we settle most cases out of court. In fact less then 10% of all our personal injury cases actually go to trial. Thorough preparation and artful negotiation pay off!
